Terms & Conditions

1. TOUR BOOKING

Before a booking is made with Extravagant Yak Travel Company, Ltd. (hereafter referred to as Extravagant Yak), all terms and conditions will be advised to you. Once you have confirmed these details we will proceed to confirm the booking by providing a tour contract for your signing. Please check that your passport is valid at least within six months of your return from your travels. Also confirm all names are the same as the relevant passport, and that travel dates provided are correct.

At the time of booking a deposit is required, and payment schedule is as follows:

  • Deposit of $600 USD per person at time of tour booking.
  • Full payment of the tour cost is due no later than 60 days prior to departure.
  • For tour bookings received within 60 days of commencement of travel, the entire tour cost is to be paid at time of confirmation.
  • If full payment is not received by 60 days before departure, Extravagant Yak reserves the right to consider your booking cancelled (per the terms of AMENDMENT AND CANCELATION (ii), below) and retain your full deposit amount.
  • Extravagant Yak reserves the right to request additional deposits if required by hotels and suppliers, especially for peak periods such as (but not limited to) Christmas, Easter, Thanksgiving and New Year. This will be communicated at the time of booking.

2. CONTRACT

For all bookings, your contract is with Extravagant Yak Travel Company, Ltd., 2 East GaoSheng Rd, Unit #1117, Chengdu, Sichuan, 610041, P.R. China. A binding contract is only entered into after we have received payment from you, in cleared funds, of either the required deposit or the full tour cost (if the booking is made within 60 days of the tour commencement). At this point, you will receive a written confirmation invoice from us by email.

3. PAYMENT

  1. Amount and Currency - Prices quoted on Extravagant Yak’s website are in $USD currency. At the time of booking you may request to pay in an alternative major currency of your choice. As such, the exact amount will be subject to the exchange rate at the time your transaction is processed, which we will inform you of prior to payment.
  2. Form of Payment - Payments may be made by either credit card (American Express, Visa, or MasterCard), or Bank Wire Transfer. Travelers making payments by credit card will receive a digital invoice from Extravagant Yak with a link to a secure payment site (powered by PayPal). Clients shall agree not to request any charge backs on their credit card until any disputed matters are resolved with Extravagant Yak. Delayed payments without advance notice may result in tour cancellation, and forfeiture of all deposits.

4. PASSPORT, VISA, OTHER TRAVEL DOCUMENTS, AND EN-ROUTE EXPENSES

For international travel, most countries now require passports to be valid for six months after you return. You are responsible to obtain a Chinese tourist visa (30 days is the most common) and a valid air ticket with your name printed exactly as it appears in your passport, You are also responsible to obtain any other necessary travel documents in advance of travel. This includes, but is not limited to, proper documentation for a single parent travelling with a child/children, documentation and/or letter from a doctor in the event of pregnancy (see below HEALTH REQUIREMENTS), proper documentation for certain health conditions, etc. We take no responsibility for refunding any out-of-pocket expenditures related to, but not limited to, your travel preparations and en-route travel to your tour’s point of commencement, such as flights, bank charges, passport/visa services, excess baggage charges, airport taxes, etc.

5. HEALTH REQUIREMENTS

  1. General - Many of our tour itineraries include points of interest and lodging at well over 3000 meters elevation. In order to ensure your comfort and in order to prevent the disruption of the tour experience for other travellers, it is a requirement that all clients be in general good health. Therefore, it is imperative that persons with medical problems make them known to us as soon as possible in the booking process or, if a medical condition arises between the booking of the tour and its commencement, prior to departure. We reserve the right to disqualify a tour participant at any time if, in our sole judgement, such a person is deemed to be medically unfit for the tour experience. Extravagant Yak assumes no liability regarding provision of medical care or any special medical accommodations. It is also your responsibility to ensure that you and those in your party consult with a medical professional and local health board to ensure that you comply with all recommended vaccinations and/or health requirements relevant to the destination(s) and modes of travel that are included in your tour. Extravagant Yak will provide a pre-trip information pack to advise you on such matters, but will not be held liable for your failure to comply with or prepare for these, and any other, travel requirements enroute.
  2. Pregnancy - Due to the general information included above, we will not accept pregnant clients past their first tri-mester on any of our overland tours. Exceptions are our Executive Tours and Custom Tours where clients may be flown to their point of destination, and avoid the more extreme elevations of overland routes. For such tours we will not accept clients who are past their fifth month of pregnancy prior to the start of the tour. Pregnant clients who choose to assume the risk of traveling must submit a statement from their physician stating they are allowed to travel. Extravagant Yak will not be held liable for any related consequences for pregnant clients, nor will we be responsible for providing medical care or special accommodations. Clients who fail to notify us of their pregnancy prior to departure risk being disqualified from a tour, in our sole discretion, and being subject to the terms of AMENDMENTS AND CANCELATION outlined below. Please note that travel insurance does not usually cover complications that arise due to pregnancy.
  3. High Elevation - Our overland routes include some of the most stunning landscape imaginable, but also expose our clients to elevations where lower levels of oxygen are felt by everyone, without respect for age or level of fitness. Generally, such effects of high elevation are limited to a slight shortness of breath (even for the most routine activities such as climbing stairs or lifting a piece of luggage), a possible slight headache the first day, and the possibility of a limited ability to enter a deep sleep at night. For the majority of people, attention to pacing themselves a little slower, resting more frequently, and increasing their hydration is sufficient to remain comfortable. Additionally, Extravagant Yak is careful to plan our itineraries with attention to allowing time on the journey to acclimatize to higher elevations along the way and we will always have supplemental oxygen on hand for exceptional circumstances when a client may be experiencing more than reasonable discomfort. There is preventative medication available to manage the effects of high elevation that, in consultation with your physician, you may consider using. Be advised that such medication does have known side effects and Extravagant Yak neither recommends nor discourages its use. We assume no liability for exceptional circumstances when a client may require special medical attention due to what are deemed to be the effects of high elevation, or if such a client experiences a deterioration of health, due to the same, that may require their withdrawal from a tour.

6. TRIP INSURANCE

Every client of Extravagant Yak is required to produce proof of purchase of a comprehensive travel insurance package protecting you before, during, and after your trip. Such a policy must provide protection against personal accidents, medical expenses, emergency evacuation, emergency repatriation, and personal liability. We also recommend trip interruption insurance in the event of a change or cancellation of flight, and insurance against loss of baggage. Clients should confirm with the insurance provider that the Tibetan plateau and western China are covered under the policy. The policy provider company name, policy name and details, policy number, and emergency contact numbers must be submitted to Extravagant Yak no later than 30 days prior to commencement of travel. Failure to produce this information will endanger your booking to cancellation (per the terms of AMENDMENTS AND CANCELATION below). It is the sole responsibility of each client to ensure their travel insurance policy is current and comprehensive for the activities and scope of operation of their trip. Extravagant Yak will not be liable for any costs associated with the above (as per the terms listed in OUR RESPONSIBILITIES TO YOU below). Each client must carry all information pertaining to the policy they purchased throughout the duration of their trip. Upon request, we are happy to provide details of travel insurance providers to our clients.

7. FLIGHTS

We do not provide air ticket sales or services for travel to and from the point of departure of our tour services, and we are not held responsible for any costs incurred due to flight delays or cancellation. If you would like us to refer you to a travel agent to assist you in arranging this portion of your travels, we are happy to do so upon request.

8. AMENDMENTS AND CANCELATION

Any cancellation or amendment request by you must be sent to us in writing and will not take effect until received by us.

  1. Amendment By You - For an amendment request after a booking has already been made, we will do our best to accommodate your request but cannot guarantee this will be possible. It may also mean that the overall cost of your tour will increase in such an event. We reserve the right to consider such a request received less than 60 days prior to the commencement of the trip as a cancellation, and in such circumstances may apply cancellation charges as specified below (Cancelation for Withdrawal By You).
  2. Cancelation or Withdrawal By You - You may cancel your tour with us at any time. Booking cancelations will incur penalties according to the following schedule:
    • More than 60 days prior to the tour commencement: forfeit of your tour deposit (USD $600).
    • 31 – 59 days prior: 50% of your tour cost will be retained.
    • 0 – 30 days prior: 100% of your tour cost will be retained.
    • Cancelation or withdrawal during the tour experience: 100% of your tour cost will be retained. We will issue no reimbursement even in the event of a Denial of Passage (see below), and we reserve the right to seek compensation for any costs incurred by us.
  3. Amendment By Us - In exceptional circumstances it may be necessary for us to make changes to a tour’s itinerary or experience. For minor changes we will do our best to inform you as soon as possible, but are not obliged to do so, and no compensation will be offered. In the event that the change is material (including, but not limited to, change of destination or change in means of transport) we will notify you of the change and offer you, (i) the opportunity of agreeing to alternative arrangements, (ii) the choice of a different tour experience with us, or (iii) the cancellation of your trip with a full refund of all fees received. Circumstances beyond the reasonable control of careful planning are considered due to “Force Majeure” (see below) and are an exception to this clause.
  4. Cancellation By Us - While we hope we never have to do this, it nevertheless remains a real, albeit small, possibility. In such an event we will notify you immediately and do all we can to offer a different tour of a comparable standard. If this fails to meet your interest or expectations, or is in any other way considered unsatisfactory to you, we will issue a full refund of all fees received.
  5. Force Majeure - Some things that are beyond the reasonable control of even the most careful planning may occur before or during your tour experience. Such events include, but are not limited to, war, threat of war, riot, social disturbances or strife, technical or maintenance problems with transport, machinery or equipment, power failure, natural disaster, adverse weather conditions, closure of airports, closure of roads, changes of schedules or operational decisions of transport providers. Compensation will not be payable by Extravagant Yak under occurrence of such unforeseeable or unusual conditions.
  6. Travel Delays - Some of our tours include domestic flights serviced by domestic airlines which may be subject to delays. In the event of a lengthy or disruptive delay that requires meals, accommodation, or other costs not reasonably inclusive of the agreed upon itinerary, Extravagant Yak will not be held responsible. Such additional costs should be covered in part or in full by your comprehensive travel insurance policy purchased prior to departure.
  7. Denial of Passage - We reserve the right to decline to accept, or disqualify en-route, any person as a member of a tour should the presence of that person be deemed, in our sole discretion, to be unreasonably disruptive to other clients’ tour experience, prejudicial to the good conduct of the tour and cultural norms of the host culture, or to be contrary to the prevailing laws of the Peoples Republic of China (see POLITICAL AND CULTURAL AWARENESS below). Under such circumstances, such a client will be considered to have willfully withdrawn from the tour experience and subjected themselves to the terms of cancellation above (ii. Cancelation or Withdrawal By You), and Extravagant Yak reserves the right to seek compensation for any costs incurred related to a client’s disqualification from a tour en-route.

9. POLITICAL AND CULTURAL AWARENESS

  1. Politics and Law - Tibet Autonomous Region and all Tibetan prefectures found in the border regions of Yunnan, Sichuan, and Qinghai provinces are part of the People’s Republic of China and subject to the laws thereof. Extravagant Yak will cooperate fully with the Chinese authorities in the event that a client should engage in any form of political activity not in compliance with Chinese Law or Policies. All such activities are harmful to all Chinese citizens and to the Tibetan people themselves. Additionally, any recreational drug use in China is strictly illegal and will not be tolerated on any Extravagant Yak tour. We will accept no liability for the consequences of any client’s disregard for, and/or breaking the laws of the P.R. China in these, or any other such manner.
  2. Culture - All clients agree to and accept the responsibility of showing utmost respect for the way of life, beliefs, and values of the host culture. Such respect ensures the maximum enjoyment of the client and their party, as well as future tours operated by Extravagant Yak. A list of culturally appropriate behaviour will be provided to every client, along with guidelines to maximize their tour experience. In regard to cultural appropriateness, each client agrees to abide by the decisions and requests of the tour leaders without question. Disregard for such cultural respect and sensitivity will not be taken lightly by Extravagant Yak and could, in our sole discretion, result in a client’s disqualification from the remainder of a tour (per the terms of AMENDMENTS AND CANCELATION above). In such an event, we will not be liable for any expense and/or inconvenience caused to the client.

10. CLAIMS & REFUND POLICY

Except for verifiable extenuating circumstances, there are no refunds, whatsoever, for any unused tour services including but not limited to accommodations, meals, internal flights or sightseeing. Any refunds for unused tour services shall be issued in the sole discretion of Extravagant Yak. Any adjustment considered will be based on the actual cost of the service involved and not on a per diem basis. Any refund claims must be made in writing to us within 30 days of tour termination. We will not consider any request for refund received after 30 days of a tour’s termination date.

11. OUR RESPONSIBILITIES TO YOU

Extravagant Yak takes care to ensure that we use the utmost attention to detail and care in the preparation and supply of your tour. Please remember that the appropriate standards will be those prevalent in your tour destination(s). We will always do our best to ensure you have the utmost comfort available. If your tour experience fails to satisfy the standard supplied in the tour description we agree to pay reasonable compensation, up to a maximum of 50% of the tour cost, at our own discretion. Such a complaint must be made in writing within 30 days of your tour’s completion providing relevant details. We will not be held liable for (i) any circumstance arising from fault on your part or the part of any member of your party, (ii) any circumstance arising from fault on the part of someone not connected with the provision of the booked tour experience and/or its components, (iii) any circumstance which arises due to unusual or unexpected circumstances beyond our reasonable control which could not have been avoided, or (iv) any circumstance which arises due to an event which we could not anticipate, expect or reasonably prevent. In all cases, and where appropriate, our liability to you and your party is limited in accordance with, and as if we were a hotel, airline or other transportation provider governed by various international conventions. This limitation of liability applies to claims for, but not limited to, death, injury, illness, and loss, damage, delay in the transportation of luggage and personal belongings. Copies of applicable conventions will be provided upon request.

12. JURISDICTION

This Contract shall be governed by and construed in accordance with Chinese Law. Any dispute arising from, or in connection with this Contract, or related to any matter which is the subject of the Contract, shall be submitted to the Chengdu Arbitration Commission for arbitration which shall be conducted in accordance with the Chengdu Arbitration Commission’s arbitration rules in effect at the time of applying for arbitration. The arbitral award is final and binding upon both parties.
